These terms govern your use of EPA Compliance Plus, operated by Bio-Pure Products, Inc. By using the service you agree to them. If you use it on behalf of a practice or company, you represent that you are authorized to bind that organization.
EPA Compliance Plus is a recordkeeping and reminder aid. It is not legal advice, and it does not certify or guarantee regulatory compliance.
It does not replace, and you remain responsible for: your separator manufacturer's current operating manual; the requirements of your Control Authority (which may be a local wastewater utility, a state agency, or an EPA Regional Office, and may impose additional or different requirements); and applicable federal, state, and local law. Determining whether your practice is subject to 40 CFR Part 441, and complying with it, is your responsibility.
Inspection schedules are derived from manufacturer documentation recorded in our rules library. We work to keep that data accurate and source-referenced, but you must verify it against your own equipment's current manual. Where the manual and the app disagree, the manual governs.
Photographs and timestamps recorded through the service are evidence that an inspection was submitted. They do not by themselves establish that equipment is functioning properly or that a practice is in compliance.
"EPA" refers to the U.S. Environmental Protection Agency. EPA Compliance Plus is not affiliated with, endorsed by, sponsored by, or approved by the EPA or any government agency. The name describes what the service helps you document — compliance with an EPA rule — and implies no governmental relationship of any kind.
EPA Compliance Plus is provided at no software charge as part of an active Bio-Pure evacuation-system product program. Bio-Pure products are not required by the EPA, and nothing in this service should be read as stating otherwise. Product purchases are governed by the terms of sale that accompany them.
Your records remain available to you. Viewing, downloading, and exporting compliance records you have already logged remains available to your practice at no charge, permanently, regardless of whether your product program, subscription, or dealer relationship is active or has ended.
Submitted compliance records are immutable. Corrections are recorded as amendments that preserve the original record, photograph, timestamp, and hash, and amendment history appears in exports. This protects the evidentiary value of your records — including against us.
Reminder messaging is governed by the SMS Reminders & Opt-In Terms. Message frequency varies; message and data rates may apply; reply STOP to unsubscribe and HELP for help. Delivery depends on carriers and is not guaranteed — a missed reminder does not excuse a missed inspection, and you remain responsible for your compliance obligations.
We aim for high availability but do not guarantee uninterrupted service. We may modify or discontinue features. If we discontinue the service materially, we will give reasonable notice and a means to export your records.
Except as expressly stated, the service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will result in regulatory compliance or in a passed inspection.
To the maximum extent permitted by law, Bio-Pure Products, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability arising out of or relating to the service will not exceed the greater of (a) the amounts you paid us for the service in the twelve months before the claim, or (b) one hundred dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this may not apply to you. Nothing here limits liability that cannot lawfully be limited.
You will indemnify and hold us harmless from claims arising out of your misuse of the service, your violation of these terms or of law, or the inaccuracy of records you submit.
You may stop using the service at any time. We may suspend or terminate access for breach of these terms or unlawful use. On termination, your practice retains the record-access rights described above.
These terms are governed by the laws of the State of Nevada, without regard to conflict of laws rules, and the state and federal courts located there will have exclusive jurisdiction.
We may update these terms and will post material changes here with an updated date. Continued use after changes take effect constitutes acceptance.
